Pasco man receives maximum sentence for illegal reentry after prior violent convictions

A man from Pasco, Washington, has been sentenced to 30 months in prison for illegally reentering the United States after being deported multiple times. The sentencing took place on October 2, 2025, with United States District Judge Mary K. Dimke presiding over the case. Jose Luis Cruz-Agustin, 37, will also face a three-year term of supervised release after his imprisonment.

Court documents state that Cruz-Agustin was arrested in March 2025 for driving under the influence and booked into Franklin County jail. Immigration and Customs Enforcement (ICE) officers then discovered he had previous convictions in Washington state for rape in the third degree, assault in the third degree with substantial pain, and furnishing liquor to a minor. These offenses occurred in 2015 when Cruz-Agustin raped two 15-year-old girls after providing them with alcohol. He was sentenced to 15 months in prison and deported to Mexico as an unlawful alien.

In addition to these convictions, ICE found that Cruz-Agustin had been convicted in 2014 of domestic violence offenses. The incident involved him chasing his then-girlfriend by car while her young child was present, blocking her vehicle, dragging her out of the car, physically assaulting her, and attempting sexual assault.

Cruz-Agustin unlawfully returned to the United States in September 2016 and was apprehended in Arizona. He was charged with unlawful reentry after deportation and sentenced to 21 months of imprisonment before being deported again in March 2018. He returned once more on or before March 2025.

Judge Dimke imposed the maximum sentence allowed under federal guidelines at the request of prosecutors. During sentencing, Judge Dimke said this decision was justified because of Cruz-Agustin’s repeated violence against minors and women and his continued illegal reentries into the country.

United States Attorney Pete Serrano stated: “While unlawfully present in the United States, Jose Luis Cruz-Agustin has terrorized and assaulted multiple minors and young women in the Eastern District of Washington. His conduct is unconscionable, as reflected by his sentence. I hope this sentence sends a message with similar intentions: do not conduct yourself this way in Eastern Washington; such behavior is not tolerated here.”

Laura Hermosillo, acting Field Office Director for ICE ERO Seattle added: “Unlawful reentry after removal is a federal offense, and Cruz’s sentence reflects the seriousness of that crime. This criminal illegal alien and convicted rapist is exactly the kind of public-safety threat we prioritize in our daily immigration enforcement actions —the worst of the worst. He remains in custody and is facing removal, and ICE will keep working to protect the American people and uphold the rule of law.”

The investigation was conducted by Immigration and Customs Enforcement (ICE), with prosecution led by Assistant United States Attorney Laurel J. Holland.
