U.S. District Court may appoint new U.S. Attorney if vacancy remains unfilled

The U.S. District Court for the Western District of Washington has announced its intention to appoint a United States Attorney under 28 U.S.C. § 546(d) if the President does not nominate, with Senate approval, a candidate for the position before February 3, 2026.

According to the court’s order, attorneys interested in being considered for appointment must submit their applications to Joshua C. Lewis, District Court Executive and Clerk of Court. Applications can be sent either by mail to the court’s Seattle address or via email at ClerkofCourt@wawd.uscourts.gov. The court will give preference to applications received by March 16, 2026, but the position will remain open until filled.

Applicants selected for interviews will be required to provide additional background information such as published writings, public statements, significant cases they have litigated, and any lobbying activities or potential conflicts.

The court stated: “The Court will keep all submissions confidential and will not disclose the identity of anyone expressing an interest in the position without first seeking permission from the applicant.”

This process follows federal law that allows district courts to appoint a United States Attorney if no presidential appointment is made and confirmed within a specified period.
